INCIDENT: H&S 11378, Sales of Methamphetamine

LOCATION: Highland Ave and Central Ave., City of San Bernardino

SUSPECT: Robert Gutierrez, 36 year old male, resident of San Bernardino

Summary

On Saturday, September 24, 2016 at 11:22 p.m. Deputy A. Lopez saw the 36-year-old “Little Counts” gang member, Robert Gutierrez, loitering out in front of a local motel. Gutierrez saw the deputy drive into the parking lot then tossed an object into a nearby bush. The deputy saw Gutierrez toss the object. The deputy contacted Gutierrez and he stated he was on probation for felony evading. While talking with Gutierrez, he had the signs and symptoms of being under the influence of a central nervous system stimulant and detained Gutierrez for further investigation. The deputy went to the location where Gutierrez tossed an unknown object and he located two clear plastic baggies containing a white crystal substance believed to be methamphetamine. The deputy arrested Gutierrez and located a large amount of US currency indicative of narcotic sales.

Gutierrez was arrested for sales of methamphetamine and a PRCS probation violation. Lopez transported and booked Gutierrez into the Central Detention Center without incident.

Suspect Gutierrez was on felony PRCS probation. Felony PRCS probation was created as a result of California Assembly Bill 109 (AB109).

As part of Governor Jerry Brown’s Realignment Plan, or Assembly Bill 109, to comply with a U.S. Supreme Court Decision requiring the state to lower its prison population; offenders with non-violent, non-sexual and non-serious convictions will serve reduced sentences in county jails and be placed on local supervision through county probation.
